Anthropic's proposed AI safety bill only kicks in if 50 deaths or $1B in damages

Anthropic is lobbying for federal AI-safety legislation that would let the U.S. government seek to block an AI model’s release only when it could cause at least $1 billion in damage or kill or injure more than 50 people. The covered risks include creating or releasing a bioweapon, conducting AI-enabled cyberattacks, or an AI lab losing control of a model or its agents. Under the proposal, an independent evaluator registered with the Commerce Department would periodically assess AI labs and their models. Labs could pay evaluators only if doing so does not compromise their independence. Evaluators would have 72 hours to report qualifying risks to the department. The Commerce Department would then present evidence to a federal judge in the U.S. District Court for the District of Columbia, who would decide whether to halt the model’s release. The proposal would prevent other U.S. departments, agencies, or officers from ordering an AI lab to stop releasing a model. Anthropic said the bill reflects the Advanced AI Framework it has advocated to federal and state lawmakers since June and called the measures sensible policies for Congress to enact. Separate AI-safety proposals include congressional work on kill-switch requirements for powerful models and Senator Bernie Sanders’s proposal for a 20-year prison sentence for developing AI superintelligence.
